OFFICIAL RULES


NO PURCHASE NECESSARY TO ENTER OR WIN THIS CONTEST. ENTRY INTO THE CONTEST REQUIRES PERMISSION FROM A PARENT / LEGAL GUARDIAN. ALL ELIGIBLE SUBMISSIONS WILL BE UPLOADED TO THE WEBSITE FOR PUBLIC VIEWING, RATING AND / OR VOTING.

DATES OF PROMOTION: The BusRadio “Youth Art Month” Contest (the “Contest”) begins at 12:01 a.m. Eastern Time (“ET”) on March 17, 2008 and ends at 11:59 p.m. (ET) on April 11, 2008 (the “Contest Period”).

ELIGIBILITY: The Contest is open to legal residents of the 50 United States including the District of Columbia who are between the ages of 5 and 18 at the time of entry (the “Entrant”). Each Entrant must attend a School that is an Elementary, Middle or High School, Grades K-12 (public or not-for-profit private). Employees and their immediate family members (parents, children, siblings or spouse, regardless of where they live, or persons living in same household, whether related or not) of BusRadio and Blick Art Materials (the “Sponsors”), their parent companies, contractors, subsidiaries, distributors, sales representatives, retailers, advertising and promotion agencies, and any others engaged in the development, production, execution or distribution of this Contest are not eligible to participate. Void in Puerto Rico and where ever else restricted or prohibited by law.

HOW TO ENTER: Visit www.busradio.com (the “Website”) during the Contest Period and with your parent or legal guardian’s permission, complete and submit the following required steps (collectively, the “Submission”):

  1. Contest Entry Form: Fill out the Official Contest Entry Form in its entirety, including your first name, date of birth, parent’s telephone number (including area code), and grade level. Then, select the school in which you attend from the drop down menu. Collection and use of personally identifiable information will be in accordance with the BusRadio Privacy Policy as posted on www.busradio.com.
  2. Upload Your Artwork: Digitally submit a photograph of your original piece of artwork (Eligible categories of artwork include, but are not limited to; Photography, Paintings, Drawings, Sculpture, Jewelry, Glass, Ceramics, Textiles, etc.) in jpg, gif, bmp, png or tif format with a file size under 5mb and click on the “Submit” button.

You must complete the entire Login/Configuration process in order to receive your entry into the Contest. If you abort the Login/Configuration process before it is complete, or if you intentionally un-configure before the end of the Contest, you will not be eligible to win.

  1. Submit a Consent Form: Download a Consent Form by clicking on the “Consent Form” link on the Website. To find the Consent Form click on the 'How does it work?' link. This will take you to the Contest Entry Guide Form. Scroll down to the 'Submission Guidelines' section and there is a link under that section which will allow you to download the Consent Form. Once the form has been downloaded, fill out the Consent Form in its entirety and return to the Sponsor by April 11, 2008 via one of the following methods: (a) Mail: Promotions Department, 160 Gould Street, Suite 201, Needham, MA 02494; (b) Fax: 781-444-2391; or (c) Email: hpratt@busradio.com.

Regardless of your age, a completed Consent Form must be submitted in order for your Submission to be eligible. The Consent Form must be completed by the parent and/or legal guardian of any Entrant between the age of 5 and 17. Entrants 18 years of age may complete the Consent Form without the signature of a parent and/or legal guardian. In the event a Consent Form is not received by April 11, 2008, your Submission will not be accepted and you will not be eligible to win a prize.

  1. Multiple artwork submissions are permitted. Late Submissions will not be accepted. Sponsors are not responsible for lost, late, mutilated, incomplete Submissions or for the quality of any photograph submitted or posted on the Website. All Submissions shall become the exclusive property of the Sponsors and will not be returned. Sponsors have no obligation to acknowledge receipt of or to return any Submissions received. Photographs that; (a) contain personably identifiable information; (b) are determined by the Sponsors and/or the judges in their sole discretion to be indecent, offensive, inappropriate or morally objectionable (c) are not in accordance with their school district’s policy; (d) are otherwise unfit for publication to the Website; or (e) violate these Official Contest rules will not be eligible. Entrants warrant and represent that; (a) their Submission does not violate any third party legal rights (including without limitation rights of privacy and publicity) and otherwise does not violate applicable law; and (b) that the Submission does not contain any disabling device, virus, worm, back door or other disruptive or malicious code that may or are intended to impair their intended performance or otherwise permit unauthorized access to, hamper, delete or damage any computer system, software, network or data.


WINNING: All eligible Submissions will be placed in a category based upon the grade level of the entrant (the “Category”). The three Categories are; (a) Elementary School (consisting of Grades K-5); (b) Middle School (consisting of Grades 6-8); and (c) High School (consisting of grades 9-12). Individual judges will determine winners based upon the following two judging phases:

Phase 1: Between April 12, 2008 and April 21, 2008, an independent panel of judges will select ten (10) semi-finalists from each Category from amongst all eligible Submissions received. Within each Category, eligible Submissions will be judged by a qualified panel of judges on the basis of; (a) Creativity (34%); (b) Content (33%); and (c) Originality (33%). Students with multiple Submissions in each Category will not be chosen more than once as a finalist within each Category. In the event of a tie within a Category, the Submissions involved will be re-judged by an additional judge who will serve as a tiebreaker and evaluate such tied Submissions according to the criteria listed above. If a student with multiple Submissions is chosen as a finalist more than once, all Submissions will be re-judged by an additional judge who will serve to find an alternate finalist and evaluate all of the Submissions again according to the criteria listed above. All judging will be conducted under the supervision of an independent panel of judges, whose decisions are final in all matters relating to this Contest. Potential Semi-Finalists and their parent / legal guardian will be notified by telephone on or about April 22, 2008.

Semi-Finalist Verification: In order to be eligible for the second phase of judging, each semi-finalist’s parent or legal guardian and semi-finalist’s school will be required, within five (5) days of notification, to sign and return (via a pre-paid FedEx envelope) a; (a) Semi-Finalist Affidavit of Eligibility / Liability / Publicity Release Form; (b) School Affidavit of Eligibility / Liability / Publicity Release Form stating that if selected as a winner, it will use the prize as described; (c) School Premise Permit; and (d) an IRS Form W-9 (collectively, the “Required Documents”). If the Required Documents are not returned by the date indicated, potential semi-finalist forfeits their right to participate in the second phase of judging and an alternate semi-finalist will be selected based upon the criteria outlined in Phase one. The execution and return of the Required Documents does not constitute the winning of any prize. Winners will be determined based upon the results received in the second phase of judging.

Phase 2: Between April 29, 2008 and May 13, 2008 at 11:59 p.m., the Submissions of the thirty (30) semi-finalists will be posted on the Website to be judged by public vote in order to determine the winners of the Contest. Winners will be determined as follows:
a. Grand Prize Winner: The semi-finalist who receives the highest number of public votes will be deemed the Grand Prize Winner for the Category in which they belong.
b. First Prize Winner: The semi-finalist who receives the second highest number of public votes will be deemed the First Prize Winner for the Category in which they belong. In the event the semi-finalist with the second highest number of votes belongs to the same Category as the Grand Prize Winner, the First Prize Winner will be determined by the next highest number of votes received for the semi-finalist belonging to one of the two remaining non-winning Categories.
c. Second Prize Winner: The Second Prize Winner will be determined by the highest number of votes received for the semi-finalist belonging to the remaining non-winning Category.
In the event of a tie for any prize level, the Submissions involved will be judged by an additional judge who will serve as a tiebreaker and judge based upon the criteria listed in Phase 1. All judging of eligible Submissions will be under the supervision of an independent panel of judges, whose decisions are final in all matters relating to the Contest. Winners will be notified by telephone on or about 7-days after phase two is complete.

PRIZES:

GRAND PRIZE: One (1) Grand Prize will be awarded inclusive of; (a) a $300 Blick Art Materials Gift Card to be awarded to the Grand Prize winner; (b) a $2,600 Blick Art Materials Gift Card to be awarded to the School in which the Grand Prize winner attends; and (c) an Art Show hosted by the Sponsor to be held on a mutually agreed upon date at the School in which the Grand Prize winner attends or at a venue of the Sponsors Sole choosing. The actual Approximate Retail Value (the “ARV”) of the Art show may vary based upon the date and location agreed upon. Any difference between the stated ARV and the actual value of the Art show will not be awarded. The total maximum ARV of the Grand Prize is $4,400.

FIRST PRIZE: One (1) First Prize will be awarded inclusive of; (a) a $300 Blick Art Materials Gift Card to be awarded to the First Prize winner; and (b) a $1,000 Blick Art Materials Gift Card to be awarded to the School in which the First Prize winner attends. The Total ARV of the First Prize is $1,300.

SECOND PRIZE: One (1) Second Prize will be awarded inclusive of; (a) a $300 Blick Art Materials Gift Card to be awarded to the Second Prize winner; and (b) a $500 Blick Art Materials Gift Card to be awarded to the School in which the Second Prize winner attends. The Total ARV of the Second Prize is $800.

The maximum total ARV of all prizes to be awarded is $6,500. Limit of one (1) prize per Category. Prizes are non- transferable and no cash redemption or substitution allowed, except at Sponsor’s sole discretion. Winners (or their parent or legal guardian if winner is not the age of majority in his/her state of residence) are solely responsible for all matters that may become due in respect to the prize, including, but not limited to, all applicable federal, state and local taxes. The School of each winner will be responsible for all applicable federal, state and local taxes associated with the Grand and First Prizes. All prizes will be awarded.

PRIZE CONDITIONS: All prizes will be awarded 3-4 weeks after all winners are determined. The date and time of the Art Show to be awarded to the Grand Prize winning School is subject to a mutually agreed upon date determined by the Grand Prize winning School and the Sponsors. In the event the Grand Prize winning School elects not to accept or participate in the Art Show for any reason, no alternative prize will be awarded. All winners (or their parent or legal guardian if winner is not the age of majority in his/her state of residence) and winning schools are required to comply with any and all applicable federal, state and local laws, rules and regulations. All prize winners consent to the use of his/her/its name, likeness, biographical information, and voice in advertising worldwide without additional compensation.

GENERAL RULES OF PARTICIPATION: This Contest is subject to all applicable federal, state and local laws. By participating, Entrants (or their parent or legal guardian if Entrant is not the age of majority in his/her state of residence) and their participating Entities agree to be bound by these Official Rules and the decisions of the Sponsors and waive any right to claim ambiguity in the Contest or these Official Rules. Sponsors are not responsible for lost, late, misdirected, undeliverable or incomplete Submissions, whether due to system errors or failures, faulty transmissions or other telecommunications malfunctions, Submissions not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise. Sponsors may prohibit an Entrant (or their parent or legal guardian if Entrant is not the age of majority in his/her state of residence) from participating in the Contest or winning a prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other Entrants, Sponsors, or Contest Entities. If for any reason this Contest is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsors which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, then Sponsors reserve the right at their sole discretion to cancel, terminate, modify or suspend the Contest and judge from those Submissions received up to the cancellation/suspension date. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUALTO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

NO LIABILITY: By participating, Entrants (or their parent or legal guardian if Entrant is not the age of majority in his/her state of residence) agree to release, discharge, indemnify and hold harmless the Sponsors, Contest Entities and each of their respective officers, directors, employees, representatives and agents from and against any claims made by winners, Entrants, or any other third parties, related in any way to the operation of this Contest as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Contest-related activity or participation in this Contest.
