BusRadio “Boys Like Girls School Concert” Contest
OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN THIS CONTEST. ENTRY INTO THE CONTEST REQUIRES PERMISSION FROM A PARENT / LEGAL GUARDIAN (SEE CONSENT FORM INSTRUCTIONS IN THE “HOW TO ENTER” SECTION OF THESE OFFICIAL RULES). ALL ELIGIBLE SONGS WILL BE UPLOADED TO THE WEBSITE FOR PUBLIC VIEWING, RATING AND / OR VOTING.
DATES OF PROMOTION: The BusRadio “Boys Like Girls School Concert” Contest (the “Contest”) begins at 12:01 a.m. Eastern Time (“ET”) on April 21, 2008 and ends at 11:59 p.m. (ET) on May 9, 2008 (the “Contest Period”).
ELIGIBILITY: The Contest is open to legal residents of the 50 United States including the District of Columbia who are between the ages of 11 and 18 at the time of entry (the “Entrant”). Each Entrant must attend a School that is a Middle or High School, Grades 6-12 (public or not-for-profit private). Employees and their immediate family members (parents, children, siblings or spouse, regardless of where they live, or persons living in same household, whether related or not) of BusRadio (the “Sponsor”), their parent companies, contractors, subsidiaries, distributors, sales representatives, retailers, advertising and promotion agencies, and any others engaged in the development, production, execution or distribution of this Contest are not eligible to participate. Void in Puerto Rico and where ever else restricted or prohibited by law.
HOW TO ENTER: In order to be eligible for the Contest, Entrants must sing at least thirty (30) seconds of their favorite “Boys Like Girls” song (the “Song”) and supply their Song (along with their parent or legal guardian’s permission) via one of the two (2) entry methods outlined below:
1. Online Entry: Visit www.busradio.com (the “Website”) during the Contest Period and with your parent or legal guardian’s permission, complete and submit the following; (a) Fill out the Official Contest Entry Form in its entirety, including your first name, date of birth, parent’s telephone number (including area code), and grade level. Then, select the school in which you attend from the drop down menu.; and (b) Digitally upload an Autdio recording of yourself singing the Song in .wav or .mp3 format and click the “Submit” button.
2. Telephone Entry: With your parent’s permission, call 1-877-MY-BUS-DJ during the Contest Period and when prompted by the recording, supply your first name, date of birth, parent’s telephone number (including area code) and grade level and sing your Song. All songs submitted via telephone recording will be saved separately as a .wav or .mp3 file by the Sponsor. Sponsor not responsible for faulty phone connections, disconnected calls, sound quality or any other technical malfunction of any entry made via Telephone.
REGARDLESS OF YOUR AGE, A COMPLETED CONSENT FORM MUST BE SUBMITTED IN ORDER FOR YOUR SONG TO BE ELIGBLE. Consent forms must be obtained and submitted as follows: Download a Consent Form by clicking on the “Consent Form” link found on the Website. Then fill out the Consent Form in its entirety and return to the Sponsor by June 10, 2008 via one of the following methods: (a) Mail: Promotions Department, 160 Gould Street, Suite 201, Needham, MA 02494; (b) Fax: 781-444-2391; or (c) Email: hpratt@busradio.com. The Consent Form must be completed by the parent and/or legal guardian of any Entrant between the age of 11 and 17. Entrants 18 years of age may complete the Consent Form without the signature of a parent and/or legal guardian. In the event a Consent Form is not received by May 9, 2008, your Song will not be accepted and you will not be eligible to win a prize.
Limit of one (1) Song per person during the Contest Period. Late Songs or Songs sent via regular mail will not be accepted. Sponsor not responsible for lost, late, mutilated, incomplete Songs or for the quality of any Audio or Video recording submitted or posted on the Website. All Songs shall become the exclusive property of the Sponsor and will not be returned. Sponsor has no obligation to acknowledge receipt of or to return any Songs received. Songs that; (a) contain personably identifiable information; (b) are determined by the Sponsor and/or the judges in their sole discretion to be indecent, offensive, inappropriate or morally objectionable (c) are not in accordance with their school district’s policy; (d) are otherwise unfit for publication to the Website; or (e) violate these Official Contest rules will not be eligible. Entrants warrant and represent that; (a) their Song does not violate any third party legal rights (including without limitation rights of privacy and publicity) and otherwise does not violate applicable law; and (b) that the Song does not contain any disabling device, virus, worm, back door or other disruptive or malicious code that may or are intended to impair their intended performance or otherwise permit unauthorized access to, hamper, delete or damage any computer system, software, network or data.. Any attempt by any Entrant to submit more than the stated number of Songs and/or submit Songs by using multiple/different email addresses, identities, registrations, logins, and/or any other methods will void that entrant’s Songs and that entrant may be disqualified from the Contest. Collection and use of personally identifiable information will be in accordance with the BusRadio Privacy Policy as posted on www.busradio.com
WINNING: Individual judges will determine winners based upon the following two (2) judging phases:
1. Phase 1: Between May 10, 2008 and May 13, 2008, an independent panel of judges will select ten (10) semi-finalists from amongst all eligible Songs received. Eligible Songs will be judged by a qualified panel of judges on the basis of; (a) Clarity (25%); (b) Voice Talent (25%); (c) Accuracy to original song lyrics (25%); and (d) Creativity (25%). In the event of a tie, the Songs involved will be re-judged by an additional judge who will serve as a tiebreaker and evaluate such tied Songs according to the criteria listed above. All judging will be conducted under the supervision of an independent panel of judges, whose decisions are final in all matters relating to this Contest. The ten (10) Semi-Finalists and their parent / legal guardian will be notified by telephone on or about May 14, 2008.
2. Phase 2: Between May 17, 2008 (12:00 a.m. EST) and May 28, 2008 (11:59 EST), the Songs of the ten (10) semi-finalists will be posted on the Website to be judged by public vote in order to determine the winner of the Contest. One (1) potential winning Finalist will be determined based upon the Song that receives the highest number of public votes. In the event of a tie, the Songs involved will be judged by an additional judge who will serve as a tiebreaker and judge based upon the criteria listed in Phase 1. All judging of eligible Songs will be under the supervision of an independent panel of judges, whose decisions are final in all matters relating to the Contest. The potential winning Finalist and their School will be notified by telephone on or about May 30, 2008 and announced both on air and on the Website once confirmed.
PRIZES:
FINALIST PRIZE: One (1) Prize of a “Boys Like Girls” Prize package (inclusive of one Autographed Gibson Guitar and one “Boys Like Girls” CD) will be awarded to the winning Finalist. The Approximate Retail Value (the “ARV”) of the Finalist Prize is $120.
FINALIST SCHOOL PRIZE: One (1) Prize of a “Boys Like Girls” Mini Concert (to be held on a mutually agreed upon date at the School) and $1,500 cash to be used by the School Music Department will be awarded to the School in which the winning Finalist attends. The ARV of the Finalist School Prize is $21,500.
The total ARV of all prizes to be awarded is $21,620.00. Prizes are non transferable and no cash redemption or substitution allowed, except at Sponsor’s sole discretion. Winning Finalist (or their parent or legal guardian if winner is not the age of majority in his/her state of residence) is solely responsible for all matters that may become due in respect to the prize, including, but not limited to, all applicable federal, state and local taxes. The School of the winning Finalist will be responsible for all applicable federal, state and local taxes associated with the Finalist School Prize. All prizes will be awarded.
PRIZE CONDITIONS: Except where prohibited the potential winning finalist’s parent or legal guardian and potential winning finalist’s school will be required, within five (5) days of notification, to sign and return (via a pre-paid FedEx envelope) a; (a) Finalist Affidavit of Eligibility / Liability / Publicity Release Form; (b) Finalist School Affidavit of Eligibility / Liability / Publicity Release Form stating that if selected as a winner, it will use the prize as described; (c) School Premise Permit; and (d) an IRS Form W-9 (collectively, the “Required Documents”). If the Required Documents are not returned by the date indicated, potential winning finalist forfeits their right to the prize the Semi-Finalist with the next highest number of public votes will be selected as outlined in Phase 2 of judging. All prizes will be awarded in the Summer or Fall of 2008. The date and time of the “Boys Like Girls” Mini Concert to be awarded to School of the winning Finalist is subject to a mutually agreed upon date determined by the School of the winning Finalist and the Sponsor. The winning Finalist (or their parent or legal guardian if winner is not the age of majority in his/her state of residence) and school of the winning Finalist are required to comply with any and all applicable federal, state and local laws, rules and regulations. The winning Finalist and school of the winning Finalist consent to the use of his/her/its name, likeness, biographical information, and voice in advertising worldwide without additional compensation.
GENERAL RULES OF PARTICIPATION: This Contest is subject to all applicable federal, state and local laws. By participating, Entrants (or their parent or legal guardian if Entrant is not the age of majority in his/her state of residence) and their participating Entities agree to be bound by these Official Rules and the decisions of the Sponsor and waive any right to claim ambiguity in the Contest or these Official Rules. Sponsor is not responsible for lost, late, misdirected, undeliverable or incomplete Submissions, whether due to system errors or failures, faulty transmissions or other telecommunications malfunctions, Submissions not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise. Sponsor may prohibit an Entrant (or their parent or legal guardian if Entrant is not the age of majority in his/her state of residence) from participating in the Contest or winning a prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other Entrants, Sponsor, or Contest Entities. If for any reason this Contest is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, then Sponsor reserves the right at their sole discretion to cancel, terminate, modify or suspend the Contest and judge from those Songs received up to the cancellation/suspension date. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUALTO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
NO LIABILITY: By participating, Entrants (or their parent or legal guardian if Entrant is not the age of majority in his/her state of residence) agree to release, discharge, indemnify and hold harmless the Sponsor, Contest Entities and each of their respective officers, directors, employees, representatives and agents from and against any claims made by winners, Entrants, or any other third parties, related in any way to the operation of this Contest as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Contest-related activity or participation in this Contest.
