OFFICIAL RULES


NO PURCHASE NECESSARY TO ENTER OR WIN THIS CONTEST. IF APPLICABLE, ENTRY INTO THE SEMI-FINALIST ROUND OF THE CONTEST REQUIRES PERMISSION FROM A PARENT / LEGAL GUARDIAN AS WELL AS THE SCHOOL IN WHICH THE SEMI-FINALIST ATTENDS (SEE “SEMI-FINALIST VERIFICATION” SECTION OF THESE OFFICIAL RULES). ALL ELIGIBLE SONGS WILL BE UPLOADED TO THE WEBSITE FOR PUBLIC VIEWING, RATING AND / OR VOTING.

DATES OF PROMOTION: The BusRadio “RockStar” Contest (the “Contest”) begins at 12:01 a.m. Eastern Time (“ET”) on September 24, 2008 and ends at 11:59 p.m. (ET) on November 11, 2008 (the “Contest Period”).

ELIGIBILITY: The Contest is open to legal residents of the 50 United States including the District of Columbia who are between the ages of 6 and 18 at the time of entry (the “Entrant”). Each Entrant must attend a School that is an Elementary, Middle or High School, Grades K-12 (public or not-for-profit private). Employees and their immediate family members (parents, children, siblings or spouse, regardless of where they live, or persons living in same household, whether related or not) of BusRadio and Blick Art Materials (the “Sponsors”), their parent companies, contractors, subsidiaries, distributors, sales representatives, retailers, advertising and promotion agencies, and any others engaged in the development, production, execution or distribution of this Contest are not eligible to participate. Void in Puerto Rico and where ever else restricted or prohibited by law.

HOW TO ENTER: In order to be eligible for the Contest, Entrants must sing at least thirty (30) seconds of any song and supply their song (along with their parent or legal guardian’s permission) via one of the two (2) entry methods outlined below. Songs can be submitted by an individual entrant or by a group of entrants.

1. Online Entry: Visit www.busradio.com (the “Website”) during the Contest Period and with your parent or legal guardian’s permission, complete and submit the following; (a) Fill out the Official Contest Entry Form in its entirety, including your first name, date of birth, parent’s telephone number (including area code), and grade level. Then, select the school in which you attend from the drop down menu and (b) Digitally upload an Audio recording of yourself singing the song in .wav or .mp3 format and click the “Submit” button.

2. Telephone Entry: With your parent’s permission, call 1-877-MY-BUS-DJ during the Contest Period and when prompted by the recording, supply your first name, date of birth, parent’s telephone number (including area code) and grade level and sing your song. All songs submitted via telephone recording will be saved separately as a .wav or .mp3 file by the Sponsor. Sponsor not responsible for faulty phone connections, disconnected calls, sound quality or any other technical malfunction of any entry made via Telephone.

Multiple song submissions are permitted. Late songs will not be accepted. Sponsor not responsible for lost, late, mutilated, incomplete songs or for the quality of any Audio or Video recording submitted or posted on the Website. All songs shall become the exclusive property of the Sponsor and will not be returned. Sponsor has no obligation to acknowledge receipt of or to return any songs received.

Songs that; (a) contain personably identifiable information; (b) are determined by the Sponsor and/or the judges in their sole discretion to be indecent, offensive, inappropriate or morally objectionable (c) are not in accordance with their school district’s policy; (d) are otherwise unfit for publication to the Website; or (e) violate these Official Contest rules will not be eligible.

Entrants warrant and represent that; (a) their song does not violate any third party legal rights (including without limitation rights of privacy and publicity) and otherwise does not violate applicable law; and (b) that the song does not contain any disabling device, virus, worm, back door or other disruptive or malicious code that may or are intended to impair their intended performance or otherwise permit unauthorized access to, hamper, delete or damage any computer system, software, network or data.. Collection and use of personally identifiable information will be in accordance with the BusRadio Privacy Policy as posted on www.busradio.com

 

WINNING: All eligible Submissions will be placed in a category based upon the grade level of the entrant (the “Category”). The three Categories are; (a) Elementary School (consisting of Grades K-5); (b) Middle School (consisting of Grades 6-8); and (c) High School (consisting of grades 9-12). Individual judges will determine winners based upon the following two judging phases:

Phase 1: Between November 12, 2008 and November 16, 2008, an independent panel of judges will select ten (10) finalists from each Category from amongst all eligible Submissions received. Within each Category, eligible Submissions will be judged by the qualified panel of judges on the basis of; (a) Content (25%); (b) Originality (25%) and (c) Voice and/or Music Talent (50%). In the event of a tie within a Category, the Submissions involved will be re-judged by an additional judge who will serve as a tiebreaker and evaluate such tied Submissions according to the criteria listed above. All judging will be conducted under the supervision of an independent panel of judges, whose decisions are final in all matters relating to this Contest. Potential Finalists and their parent / legal guardian will be notified by telephone on or about November 17, 2008.

Phase 2: Between November 26, 2008 and December 10, 2008, the Submissions of the thirty (30) finalists will be posted on the Website to be judged by public vote in order to determine the winners of the Contest. One (1) winner will be determined for each Category as follows:

Grand Prize Winner: The finalist who receives the highest number of public votes will be deemed the Grand Prize Winner for the Category in which they belong.

First Prize Winner: The finalist who receives the second highest number of public votes will be deemed the First Prize Winner for the Category in which they belong. In the event the semi-finalist with the second highest number of votes belongs to the same Category as the Grand Prize Winner, the First Prize Winner will be determined by the next highest number of votes received for the finalist belonging to one of the two remaining non-winning Categories.

Second Prize Winner: The Second Prize Winner will be determined by the highest number of votes received for the finalist belonging to the remaining age Category.

In the event of a tie for any prize level, the Submissions involved will be judged by an additional judge who will serve as a tiebreaker and judge based upon the criteria listed in Phase 1. All judging of eligible Submissions will be under the supervision of an independent panel of judges, whose decisions are final in all matters relating to the Contest. Winners will be notified by telephone on or about 7-days after phase two is complete.

If a student or Group with multiple Submissions is chosen as a finalist more than once, all Submissions will be re-judged by an additional judge who will serve to find an alternate finalist and evaluate all of the Submissions again according to the criteria listed above. All judging will be conducted under the supervision of an independent panel of judges, whose decisions are final in all matters relating to this Contest. Potential Semi-Finalists and their parent / legal guardian will be notified by telephone on or about April 22, 2008.

Semi-Finalist Verification: In order to be eligible for the second phase of judging, each semi-finalist’s parent or legal guardian and semi-finalist’s school will be required, within five (5) days of notification, to sign and return (via fax to 781-444-2391) a; (a) Semi-Finalist Affidavit of Eligibility / Liability / Publicity Release Form; (b) School Affidavit of Eligibility / Liability / Publicity Release Form stating that if selected as a winner, it will use the prize as described and (c) an IRS Form W-9 (collectively, the “Required Documents”). Please note that if a semi-finalist school is a public school and tax exempt we will need a tax exemption certificate/letter in place of the W-9 form. If the Required Documents are not returned by the date indicated, potential semi-finalist forfeits their right to participate in the second phase of judging and an alternate semi-finalist will be selected based upon the criteria outlined in Phase one. The execution and return of the Required Documents does not constitute the winning of any prize. Winners will be determined based upon the results received in the second phase of judging.

PRIZES:

GRAND PRIZE: One (1) Grand Prize will be awarded inclusive of; (a) a $500 cash prize to be awarded to the Grand Prize winner; (b) The Grand Prize winner’s song will be professionally produced by BusRadio and then played during BusRadio programming and (c) a $2,000 check to be awarded to the School in which the Grand Prize winner attends. The total maximum ARV of the Grand Prize is $3,000.

FIRST PRIZE: One (1) First Prize will be awarded inclusive of; (a) a $200 check to be awarded to the First Prize winner and (b) The First Prize winner’s song will be professionally produced by BusRadio and then played during BusRadio programming and (c) a $500 check to be awarded to the School in which the First Prize winner attends. The Total ARV of the First Prize is $1200.

SECOND PRIZE: One (1) Second Prize will be awarded inclusive of; (a) a $100 check prize to be awarded to the Second Prize winner and (b) The Second Prize winner’s song will be professionally produced by BusRadio and then played during BusRadio programming and (c) a $200 check to be awarded to the School in which the Second Prize winner attends. The Total ARV of the Second Prize is $800.

ONLY THREE PRIZES WILL BE AWARDED. EACH AGE CATEGORY WILL NOT RECEIVE AND GRAND PRIZE, SECOND PRIZE AND THIRD PRIZE. The maximum total ARV of all prizes to be awarded is $4,300. Limit of one (1) prize per Category. Prizes are non transferable and no cash redemption or substitution allowed, except at Sponsor’s sole discretion. All prizes will be awarded 3-4 weeks after all winners are determined. In the event the Grand Prize winning School elects not to accept the Grand Prize for any reason, no alternative prize will be awarded. All winners (or their parent or legal guardian if winner is not the age of majority in his/her state of residence) and winning school are required to comply with any and all applicable federal, state and local laws, rules and regulations. All prize winners consent to the use of his/her/its name, likeness, biographical information, and voice in advertising worldwide without additional compensation.

PRIZE CONDITIONS: Except where prohibited the potential winner’s parent or legal guardian and potential winner’s school will be required, within five (5) days of notification, to sign and return (via fax to 781-444-2391) a; (a) Semi-Finalist Affidavit of Eligibility / Liability / Publicity Release Form; (b) School Affidavit of Eligibility / Liability / Publicity Release Form stating that if selected as a winner, it will use the prize as described and (c) an IRS Form W-9 (collectively, the “Required Documents”). Please note that if a semi-finalist school is a public school and tax exempt we will need a tax exemption certificate/letter in place of the W-9 form. If the Required Documents are not returned by the date indicated, potential winning finalist forfeits their right to the prize the Semi-Finalist with the next highest number of public votes will be selected as outlined in Phase 2 of judging. All prizes will be awarded by January of 2009. The winning Finalist (or their parent or legal guardian if winner is not the age of majority in his/her state of residence) and school of the winning Finalist are required to comply with any and all applicable federal, state and local laws, rules and regulations. The winning Finalists and school of the winning Finalists consent to the use of his/her/its name, likeness, biographical information, and voice in advertising worldwide without additional compensation.

GENERAL RULES OF PARTICIPATION: This Contest is subject to all applicable federal, state and local laws. By participating, Entrants (or their parent or legal guardian if Entrant is not the age of majority in his/her state of residence) and their participating Entities agree to be bound by these Official Rules and the decisions of the Sponsor and waive any right to claim ambiguity in the Contest or these Official Rules. Sponsor is not responsible for lost, late, misdirected, undeliverable or incomplete Submissions, whether due to system errors or failures, faulty transmissions or other telecommunications malfunctions, Submissions not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise. Sponsor may prohibit an Entrant (or their parent or legal guardian if Entrant is not the age of majority in his/her state of residence) from participating in the Contest or winning a prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other Entrants, Sponsor, or Contest Entities. If for any reason this Contest is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, then Sponsor reserves the right at their sole discretion to cancel, terminate, modify or suspend the Contest and judge from those Songs received up to the cancellation/suspension date.

 

CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUALTO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

NO LIABILITY: By participating, Entrants (or their parent or legal guardian if Entrant is not the age of majority in his/her state of residence) agree to release, discharge, indemnify and hold harmless the Sponsor, Contest Entities and each of their respective officers, directors, employees, representatives and agents from and against any claims made by winners, Entrants, or any other third parties, related in any way to the operation of this Contest as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Contest-related activity or participation in this Contest.
